Terms & Conditions
These Terms and Conditions govern the provision of services by DOLD Studio’s ANZ Limited (“DOLD Studio’s”, “we”, “our”, or “us”). By engaging DOLD Studio’s, accepting a proposal, making a payment, or communicating acceptance via email, the client (“Client”, “you”, or “your”) agrees to be bound by these Terms and Conditions.
DOLD Studio’s provides project-based creative and production services including, but not limited to, branding, graphic design, web design and development, UI/UX design, social media and digital content, creative consulting, strategy, and visual production services. All services are offered on a project-by-project basis unless expressly agreed otherwise in writing.
A project will commence only after written acceptance of a proposal and receipt of the required 50% upfront booking payment, which is strictly non-refundable. All official approvals, confirmations, and project-related communications must be conducted via email. Communications through social media platforms are not recognised as formal approval or contractual acceptance.
Payments are structured as 50% upfront (non-refundable), 25% mid-project (partially refundable), and 25% final payment due prior to delivery (refundable only if delivery has not occurred). Late payments may incur interest calculated in accordance with industry standards and applicable law. Invoices are payable within industry-standard timeframes unless otherwise specified in writing. DOLD Studio’s reserves the right to pause or terminate work where payments are overdue.
Project pricing is based on defined service packages and the number of hours required by the DOLD Studio’s team. Any additional work beyond the agreed scope, including increased hours or expanded deliverables, will be assessed and charged accordingly. Revisions are limited and vary depending on the selected package. Requests outside the agreed scope or revision allowance may result in additional charges or a revised quote.
Intellectual property ownership of final deliverables will transfer to the Client within 48 working hours of full payment being received and cleared in DOLD Studio’s bank account, unless otherwise agreed in writing. Until full payment is received, all work remains the exclusive property of DOLD Studio’s. DOLD Studio’s may request permission to showcase completed work in its portfolio, website, or marketing materials, and will only do so with prior consent from the Client.
All software, fonts, tools, and assets used by DOLD Studio’s are properly licensed, and the costs associated with such licences are included in the project fees. No unauthorised third-party assets will be used. The Client warrants that all materials, content, and assets provided to DOLD Studio’s are lawful, accurate, and owned or properly licensed by the Client. DOLD Studio’s does not assume responsibility for illegal, misleading, or infringing materials supplied by the Client. Where required, DOLD Studio’s may securely retain client-provided information and, if legally compelled, may present such information as evidence.
Confidentiality obligations may apply depending on the nature of the project and will be determined on a case-by-case basis. DOLD Studio’s takes reasonable steps to safeguard all client information provided during the course of a project.
Either party may terminate a project for reasonable cause by providing formal written notice via email. If a Client disengages, ceases communication, or terminates a project without written notice, DOLD Studio’s reserves the right to pursue appropriate legal remedies. Upon termination, all completed work, incurred costs, and outstanding fees remain payable and are non-refundable. DOLD Studio’s may also terminate or suspend services immediately in cases of non-payment, breach of these Terms, or unlawful conduct.
DOLD Studio’s liability is limited to the maximum extent permitted by law and, where applicable, to the total fees paid for the relevant project. DOLD Studio’s is not liable for indirect, consequential, or business-related losses, including loss of profits, data, or opportunity. We are not responsible for failures, outages, policy changes, or limitations of third-party platforms such as hosting providers, website builders, analytics tools, or software services.
DOLD Studio’s generally does not work with minors. In rare circumstances where a project involves a minor, a supervising adult aged 21 years or older must be appointed as the primary point of contact, and identity verification may be required.
In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation before pursuing formal legal action. These Terms and Conditions are governed by the laws of New Zealand for New Zealand-based clients, India for India-based clients, and New Zealand law for all other international or cross-border engagements.
DOLD Studio’s reserves the right to amend these Terms and Conditions at any time. Updated terms will take effect immediately upon publication on our website.
